1. INTRODUCTION
These Terms & Conditions of Travel ("Terms") govern the relationship between TIMBU TRAVELTEC BRASIL, LTDA., operating under the commercial brand AWESOME BRAZIL HOLIDAYS ("Awesome Brazil Holidays", "we", "us" or "our"), and the person making a booking or purchasing travel services ("you", "traveller", "customer" or "passenger").
TIMBU TRAVELTEC BRASIL, LTDA. is a company legally established in Brazil and operates Awesome Brazil Holidays as its commercial travel brand.
These Terms apply to travel services including, but not limited to:

Group travel;

Tours;

Holiday packages;

Accommodation;
-
Flights;
-
Transfers;

Excursions;

Activities;

Retreats;

Expeditions;

Travel insurance arrangements;

Visa-related assistance;

Destination management services;

Other travel-related services arranged or supplied by Awesome Brazil Holidays.
By requesting a quotation, making a payment, accepting a booking confirmation or participating in a service arranged by Awesome Brazil Holidays, you agree to be bound by these Terms, together with the specific conditions contained in your quotation, invoice, itinerary and booking confirmation.
2. OUR ROLE
Awesome Brazil Holidays may act as:

A travel agency arranging or intermediating third-party travel services;

An organiser of certain travel experiences or packages;
-
A provider of travel planning and destination-management services;
-
An intermediary between the traveller and independent suppliers.
The precise role of Awesome Brazil Holidays will depend on the service purchased.
Where services are supplied by independent third parties, the relevant supplier may have its own contractual terms, conditions, cancellation policies and liability provisions.
Such supplier conditions may apply in addition to these Terms.
3. SUPPLIERS AND THIRD-PARTY SERVICES
Travel services may be supplied by independent companies, including:

Resorts;

Pousadas;

Transportation companies;

Boat operators;
-
Tour operators;
-
Local guides;
-
Activity providers;

Expedition operators;

Restaurants;

Other tourism suppliers.
We carefully select and coordinate suppliers where reasonably practicable. However, unless expressly stated otherwise, we do not own, operate or control every supplier involved in your journey.
Each supplier remains responsible for the proper operation of the service it provides, subject to applicable law and its contractual obligations.
4. QUOTATIONS
A quotation issued by Awesome Brazil Holidays is normally valid only for the period specified in the quotation.
Where no validity period is specified, the quotation is subject to availability and price confirmation.
A quotation may change before confirmation because of:

Supplier availability;

Airline pricing;
-
Hotel availability;
-
Exchange-rate fluctuations;
-
Taxes;
-
Government charges;
-
Seasonal pricing;
-
Changes in supplier costs;

Changes in the requested itinerary.
A quotation does not constitute a confirmed booking until the booking requirements specified by Awesome Brazil Holidays have been satisfied.
5. BOOKING CONFIRMATION
A booking is considered confirmed when:

The traveller has accepted the applicable quotation;

The required deposit or payment has been received;
-
Required traveller information has been provided; and
-
Awesome Brazil Holidays or the relevant supplier has confirmed the booking.
The booking confirmation, invoice and/or final itinerary will specify the services purchased and any applicable special conditions.
6. PRICES
Prices will be stated in the currency specified in the quotation.
Unless expressly stated otherwise, prices may be subject to change before booking confirmation.
Depending on the product, prices may include:

Meals specifically identified;

Domestic or international flights;
-
Transfers;
-
Activities;
-
Excursions;
-
Guides;
-
Entrance fees;
-
Travel insurance;

Other services expressly listed in the itinerary.
Items not expressly listed as included are considered excluded.

The definitive inclusions and exclusions are those stated in the applicable quotation and booking confirmation.
7. CURRENCY AND EXCHANGE RATES
Where prices are quoted in a currency other than Brazilian Reais, the applicable payment amount will be determined according to the terms stated in the quotation or invoice.
Currency fluctuations may affect prices for services that have not yet been confirmed.
Once a booking has been confirmed, the applicable price will be governed by the booking confirmation, subject to any contractual provisions allowing adjustments.
8. PAYMENT
Payment schedules vary according to the itinerary and supplier requirements.
A booking may require:

A non-refundable deposit;

A partial payment;

One or more instalments;
-
Full payment at the time of booking;

Full payment before a specified departure date.
The applicable payment schedule will be stated in the quotation or booking confirmation.
Failure to make a payment by the required deadline may result in:

Supplier cancellation fees;

Additional administrative costs.
Where a supplier imposes a stricter payment deadline, that deadline may apply.
9. CREDIT CARDS AND PAYMENT PROVIDERS
Payments may be processed by third-party payment providers.
Payment processing may be subject to the provider's own terms, security procedures and fees.
Where a payment provider charges a fee, currency-conversion fee or other transaction cost, this will be communicated where applicable.
Awesome Brazil Holidays does not normally store complete payment-card details.
10. BOOKING INFORMATION
You are responsible for providing accurate information required to make your booking.
This includes, where applicable:

Full legal name;

Passport name;

Date of birth;
-
Nationality;
-
Passport number;
-
Passport expiry date;
-
Visa information;
-
Contact information;
-
Emergency contact;
-
Special assistance requirements.
Airline tickets and other travel documents must normally match the traveller's official travel documents.
Costs resulting from incorrect information supplied by the traveller may be charged to the traveller.
11. PASSPORTS, VISAS AND ENTRY REQUIREMENTS
The traveller is responsible for obtaining and maintaining all documents necessary for travel.
These may include:

Valid passport;

Visa;

Transit visa;
-
Entry authorisation;
-
Health certificates;
-
Vaccination documentation;
-
Immigration documentation;
-
Other permits or documents required by authorities.
Awesome Brazil Holidays may provide general travel information or assistance with visa procedures, but unless expressly agreed otherwise, we do not guarantee that a visa or entry permission will be granted.
Immigration authorities retain the authority to determine whether a traveller may enter or transit a country.
The traveller should verify applicable requirements with the relevant government authority, embassy or consulate before departure.
12. FLIGHTS
Air transportation is provided by the relevant airline and is subject to the airline's conditions of carriage and applicable aviation regulations.
Flight schedules may change after booking.
Airlines may alter:

Departure times;

Arrival times;
-
Flight numbers;
-
Aircraft;
-
Routes;
-
Connections;
-
Operating carriers.
Where a flight is delayed, cancelled, rerouted or otherwise disrupted, the passenger's rights against the airline are governed by applicable law and the airline's conditions.
For flights departing from or operating within Brazil, applicable ANAC passenger-protection rules may apply. These include obligations concerning information, assistance and alternatives in cases of delay, cancellation and other disruptions.
Where Awesome Brazil Holidays acts only as an intermediary, we will provide reasonable assistance in communicating with the airline or relevant supplier but cannot control the airline's operational decisions.
13. FLIGHT CONNECTIONS
Travellers are responsible for observing the minimum connection requirements specified by their ticket or itinerary.
Where separate tickets are purchased, the traveller should understand that the tickets may constitute separate contracts.
Unless expressly guaranteed by Awesome Brazil Holidays in writing, we are not responsible for missed connections resulting from delays affecting separately purchased tickets.
Travellers should allow sufficient connection time, particularly when:

Changing airports;

Travelling internationally;
-
Collecting and rechecking baggage;
-
Passing through immigration;
-
Travelling on separate tickets.
14. BAGGAGE
Baggage allowances are determined by the relevant airline or transportation provider.
Additional baggage, overweight baggage, sports equipment and special items may incur additional charges.
The traveller is responsible for complying with the applicable baggage restrictions.
Awesome Brazil Holidays is not responsible for baggage loss, damage or delay except to the extent that applicable law imposes responsibility on us.
Passengers should report baggage problems immediately to the relevant airline or transportation provider.
15. ACCOMMODATION
Accommodation is provided by the relevant hotel, resort, pousada, lodge or other accommodation provider.
Room categories, facilities, check-in times, check-out times, meal plans and hotel services are subject to the hotel's conditions.
Hotel photographs and descriptions are intended to provide an accurate representation but facilities may change.
Hotels may occasionally substitute rooms or make operational changes.
Where a hotel becomes unavailable, Awesome Brazil Holidays may arrange an alternative accommodation of comparable standard where reasonably possible, subject to availability and applicable contractual terms.
16. SPECIAL REQUESTS
We are happy to communicate reasonable special requests to suppliers, including:

Connecting rooms;

Bed preferences;
-
Dietary requirements;
-
Accessibility requirements;
-
Celebration arrangements;
-
Early check-in;
-
Late check-out;
-
Other reasonable requests.
A special request is not guaranteed unless expressly confirmed in writing.
17. DIETARY, MEDICAL AND ACCESSIBILITY REQUIREMENTS
Travellers must inform us of relevant requirements before booking or as soon as they become known.
This may include:

Dietary restrictions;

Mobility requirements;
-
Accessibility requirements;
-
Medical conditions relevant to participation;

Medication requirements;
-
Other safety-related information.
We will communicate relevant information to suppliers where necessary.
However, suppliers may have limitations concerning accessibility, dietary accommodation, emergency response or medical facilities.
Travellers remain responsible for assessing whether an itinerary is appropriate for their individual circumstances.
18. ADVENTURE TRAVEL AND EXPEDITIONS
Some Awesome Brazil Holidays products involve increased physical, environmental or logistical risk.
These may include:

Mountain expeditions;

Trekking;
-
Camping;
-
River travel;
-
Boat transportation;
-
Remote communities;

Wildlife areas;

Remote-area activities;

High-altitude travel.
Such activities involve inherent risks that cannot always be eliminated.
Potential risks may include:

By booking an adventure or expedition, the traveller acknowledges the nature of the environment and agrees to follow reasonable safety instructions.
19. FITNESS AND MEDICAL REQUIREMENTS
Certain experiences may require an appropriate level of physical fitness.
A traveller may be required to provide:

Health declaration;

Emergency information;
-
Insurance documentation;
-
Fitness confirmation;
-
Other documentation required by the operator.
Awesome Brazil Holidays or the relevant operator may restrict participation where a traveller does not meet mandatory safety requirements.
This is particularly applicable to high-altitude, jungle, trekking and remote-area expeditions.
20. INDIGENOUS COMMUNITIES AND PROTECTED AREAS
Some experiences may involve visits to indigenous territories, conservation areas or other specially regulated locations.
Access may be subject to:

Indigenous-community rules;
-
Environmental regulations;
-
Local protocols;
-
Entry permits;
-
Operational restrictions;
-
Weather or environmental conditions.
Access cannot always be guaranteed.
Where an activity is changed or cancelled because the relevant authority, community or competent operator restricts access, Awesome Brazil Holidays will seek a reasonable alternative where possible, subject to the specific booking conditions and applicable law.
Travellers must respect local cultural, environmental and community rules at all times.
21. RESPONSIBLE TRAVEL
Awesome Brazil Holidays supports responsible tourism and expects travellers to respect:

Indigenous communities;

Wildlife;
-
Protected environments;
-
Cultural heritage;
-
Local laws;
-
Environmental regulations;
-
Local customs.
Travellers must not engage in behaviour that causes harm to local communities, wildlife, protected environments or other travellers.
22. TRAVEL INSURANCE
Travel insurance is strongly recommended and may be mandatory for certain services.
Unless specifically included in the booking, travel insurance is the traveller's responsibility.
We recommend that insurance covers, where appropriate:

Repatriation;

Personal liability;

Where Awesome Brazil Holidays arranges insurance on behalf of a traveller, the insurance contract remains subject to the insurer's policy terms, exclusions and limitations.
The traveller is responsible for reviewing the policy before departure.
23. CANCELLATIONS BY THE TRAVELLER
Cancellation terms vary according to the product and suppliers involved.
The applicable cancellation policy will be provided with the quotation or booking confirmation.
Cancellation charges may include:

Airline cancellation fees;

Hotel cancellation fees;

Tour-operator charges;
-
Activity cancellation fees;
-
Non-refundable deposits;
-
Insurance premiums;

Visa fees;

Administrative charges;

Where a booking is identified as non-refundable, the corresponding amount may not be recoverable.
Cancellation requests should be submitted in writing.
The date and time on which the cancellation request is received may determine the applicable cancellation fee.
24. CHANGES REQUESTED BY THE TRAVELLER
Requests to change a confirmed booking may include:

Changing room categories;

Changing participants.
Changes are subject to availability and may incur:

A change is not confirmed until communicated in writing.
25. CANCELLATION BY AWESOME BRAZIL HOLIDAYS
In exceptional circumstances, Awesome Brazil Holidays may need to cancel a service before departure.
Where cancellation is caused by circumstances within our reasonable control, we will seek to provide an appropriate solution in accordance with the applicable booking terms and mandatory law.
Where cancellation results from extraordinary circumstances beyond our reasonable control, including force majeure, we will seek to assist the traveller and suppliers in determining available alternatives.
Any refund or credit will be determined according to:

The specific booking terms;

Amounts recoverable from suppliers;

Insurance coverage;

The circumstances causing the cancellation.
Nothing in these Terms excludes mandatory consumer rights.
26. CHANGES TO AN ITINERARY
Travel itineraries may occasionally require modification.
Changes may result from:

Government restrictions;

Environmental conditions;

Transport disruptions;

Local events;

Road or river conditions;

We will seek to preserve the character and overall value of the itinerary whenever reasonably possible.
For significant changes, we will communicate the change and any rights available under applicable law and the specific booking terms.
27. FORCE MAJEURE
Awesome Brazil Holidays shall not be considered in breach of its obligations to the extent that performance is prevented or materially affected by circumstances beyond reasonable control, subject to mandatory applicable law.

Severe storms;

Earthquakes;

Epidemics or pandemics;

Other extraordinary events.
In such circumstances, we will make reasonable efforts to assist the traveller.
28. PERSONAL PROPERTY
Travellers are responsible for their personal belongings.
We recommend that valuables, passports, electronic devices, cash and other important items are kept secure.
Where a supplier provides a safe or other security facility, travellers should use it appropriately.
Loss, theft or damage should be reported immediately to the relevant supplier and, where appropriate, local authorities and the insurer.
29. TRAVELLER CONDUCT
Travellers must behave responsibly and comply with applicable laws and reasonable instructions.
A traveller may be removed from a tour, excursion, accommodation or other service where their behaviour:

Creates a safety risk;

Threatens staff or other travellers;
-
Causes serious disruption;
-
Damages property;
-
Violates local law;
-
Violates supplier rules;
-
Seriously interferes with the enjoyment or safety of others.
Additional costs resulting from serious misconduct may be charged to the traveller to the extent permitted by law.
30. ALCOHOL AND DRUGS
Travellers must comply with local laws concerning alcohol and controlled substances.
Participation in an activity while materially impaired by alcohol or drugs may be refused where necessary for safety.
No refund will necessarily be available where a traveller is excluded from an activity because of unsafe or unlawful behaviour, subject to mandatory law.
31. MINORS
Travellers under the age of 18 may require the accompaniment and supervision of a parent, legal guardian or authorised adult.
Certain activities may impose minimum-age requirements.
Parents or legal guardians are responsible for ensuring that minors comply with applicable requirements.
32. PHOTOGRAPHY AND MARKETING
Photographs or video may be taken during group activities for operational, documentary or promotional purposes.
Where identifiable individuals are used in promotional materials, Awesome Brazil Holidays will obtain the appropriate permission or rely on another lawful basis where required by applicable law.
Travellers may contact us regarding questions concerning the use of their image.
Personal-data processing is further addressed in our Privacy Policy.
33. COMPLAINTS
We encourage travellers to raise concerns as soon as possible so that we have a reasonable opportunity to resolve them during the trip.
Where a problem occurs with a supplier, the traveller should notify:

34. SUPPLIER COMPLAINTS
Where a complaint relates directly to an airline, hotel, insurer or other independent supplier, the traveller may also need to submit a complaint directly to that supplier.
Awesome Brazil Holidays will provide reasonable assistance where appropriate, but cannot determine the supplier's internal complaint outcome.
35. LIABILITY
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Subject to mandatory consumer protection legislation, Awesome Brazil Holidays will be responsible only to the extent provided by applicable law and the contractual role it has undertaken in relation to the relevant service.
Where a third-party supplier is independently responsible for a service, the supplier remains responsible for its own acts and omissions in accordance with applicable law.
Nothing in these Terms is intended to exclude liability for death, personal injury, fraud, wilful misconduct or any other liability that cannot legally be excluded or limited.
36. CONSUMER PROTECTION
These Terms are intended to operate consistently with applicable consumer protection legislation.
For services provided in Brazil, applicable legislation may include:

Brazilian Consumer Protection Code — Law No. 8.078/1990;

Tourism Law — Law No. 11.771/2008;

Law governing tourism agencies — Law No. 12.974/2014;

Brazilian Civil Code;

Applicable ANAC regulations;

Other applicable federal, state and municipal legislation.
Brazilian tourism legislation provides the legal framework for tourism service providers, and Cadastur registration is mandatory for tourism agencies.
Where mandatory consumer protection legislation in another jurisdiction applies to a traveller, these Terms do not intend to remove or restrict rights that cannot legally be excluded.
37. INTERNATIONAL CUSTOMERS
Awesome Brazil Holidays serves travellers from different countries.
Customers travelling from outside Brazil should understand that:

Different laws may apply to different components of a trip;

Airlines may be governed by international aviation conventions and national regulations;

Hotels and local suppliers may operate under the laws of their own jurisdiction;

Insurance policies are governed by their own contractual terms;

Immigration decisions are made by the competent authorities.
Where mandatory laws provide greater consumer protection than these Terms, those mandatory rights will prevail.
38. DATA PROTECTION
Personal data provided during the booking process will be processed in accordance with the Awesome Brazil Holidays Privacy Policy.

39. ELECTRONIC COMMUNICATIONS
You agree that we may communicate with you electronically regarding your booking.
This may include:

Electronic booking platforms;

Other communication methods agreed between the parties.
Electronic communications may include booking confirmations, invoices, travel documents, itinerary changes and urgent travel information.
You are responsible for ensuring that the contact details supplied to us remain accurate.
40. WEBSITE INFORMATION
Information published on the Awesome Brazil Holidays website is provided for general travel and informational purposes.
While we make reasonable efforts to maintain accurate information, we do not guarantee that all website content will always be:

Current;
-
Error-free;
-
Available;
-
Suitable for every traveller.
Destination conditions may change without notice.
The specific booking confirmation takes precedence over general website information where the two differ.
41. INTELLECTUAL PROPERTY
All intellectual property associated with Awesome Brazil Holidays, including:

Logos;

Text;

Itineraries;

Photographs;

Videos;

Graphics;

Website designs;

Marketing materials;
is owned by, licensed to or otherwise lawfully used by TIMBU TRAVELTEC BRASIL, LTDA. and may not be reproduced or commercially exploited without permission, except where permitted by law.
42. RESPONSIBLE TOURISM
Awesome Brazil Holidays seeks to promote responsible and sustainable travel.
Travellers are expected to:

Respect local communities;

Respect indigenous communities;
-
Follow environmental regulations;
-
Avoid damaging natural environments;
-
Respect wildlife;
-
Follow local cultural protocols;
-
Avoid illegal activities;
-
Follow instructions from guides and local authorities.
Where an itinerary includes protected or indigenous areas, additional rules may apply.
43. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
The invalid provision shall be interpreted or replaced, where legally possible, in a manner that most closely reflects its original purpose.
44. NO WAIVER
Failure by Awesome Brazil Holidays to enforce a provision of these Terms does not constitute a waiver of our right to enforce that provision later.
45. CHANGES TO THESE TERMS
We may update these Terms from time to time.
The version applicable to a booking will normally be the version accepted at the time of booking, subject to:

Mandatory consumer protection rights.

46. GOVERNING LAW
These Terms shall be interpreted in accordance with Brazilian law, subject to mandatory consumer protection and other applicable laws.
Nothing in these Terms is intended to deprive a consumer of mandatory rights available under the laws that apply to the relevant transaction.
Where Brazilian law governs the relationship, disputes shall be handled by the competent court in accordance with applicable procedural and consumer-protection legislation.
